    In the lawsuit Miot et al. v. Trump et al., No. 25-cv-02471-ACR (D.D.C.), a federal court order was issued on February 2, 2026, staying the termination of the TPS designation for Haiti.

    Effect of the Order

    The stay means the termination is null, void, and of no legal effect. Haitian TPS holders maintain their lawful status and protections, including work authorization and protection from detention and deportation, pending judicial review.

    EAD Extension

    The validity of Employment Authorization Documents (EADs) issued under the Haiti TPS designation is extended per this court order.

    Guidance for State Departments of Motor Vehicles (DMVs)

    As a result of the court-ordered stay, we urge all State DMVs to recognize the continued validity of TPS and to ensure consistent compliance with federal law:

    Continued Validity of Licenses

    All current driver’s licenses held by Haitian TPS holders remain valid. DMV staff must not suspend, cancel, deny, or refuse to issue or renew a driver’s license based solely on an individual’s TPS status.

    Accepting TPS as Lawful Status

    DMVs must recognize Haitian TPS as lawful status when reviewing or approving any pending or new driver’s license applications.

    Federal Eligibility under the REAL ID Act

    Federal law supports the right of TPS holders to obtain a driver’s license.

    Under the REAL ID Act of 2005, states are authorized to issue temporary driver’s licenses or ID cards to individuals who are lawfully present in the United States, which includes non-citizens with TPS. The temporary license:

    Validity Period

    Shall be valid only during the period of the applicant’s authorized stay, or for a period of one year if there is no definite end to the period of authorized stay.

    Eligibility

    This entitlement applies to all individuals with “a pending or approved application for temporary protected status in the United States.”

    In states with large TPS populations, like Florida, local authorities have confirmed their compliance with the federal court order.

    Beneficiaries are eligible for driver’s license services through February 3, 2026, reflecting the period during which authorities must recognize their documentation.

    Honduras & Nicaragua

    Beneficiaries with valid documentation are eligible for driver’s license services through September 9, 2025.

    Renewing Your Driver's License as a TPS Holder

    To prove lawful status when applying for a new license or renewing an existing one, TPS holders typically must show:

    • A valid TPS approval notice (Form I-797 or similar).
    • A current Employment Authorization Document (EAD), which may be automatically extended due to court order.
